A black person in Toronto is nearly 20 times more likely than a white person to be shot and killed by police, according to a new Ontario Human Rights Commission report on race and policing. U.S. law forbids any school receiving federal aid to discriminate on the basis of sex, and many schools have implemented policies to prevent sexual harassment and assault. But are colleges the right authority to investigate and resolve cases of sexual assault on campuses? Some argue that colleges are ill-suited to decide such cases, which require the impartiality and protections that only the criminal justice system can provide. But others argue that the court system complicates and undermines a process that colleges are better able to handle. Should courts or campuses decide cases of sexual assault?

This episode of The Green Interview features Ron Plain and Ada Lockridge, two members of the Aamjiwnaang First Nation, a native community in the heart of Ontario's notorious “Chemical Valley,” who have launched a lawsuit to prove that Canadians have constitutional rights to clean air, clean water, and a healthy environment. According to the World Health Organization, the area has the worst air quality in Canada—pumping out more air pollution than the entire provinces of Manitoba or Saskatchewan or New Brunswick. Aided by the environmental law organization Ecojustice, the pair is arguing that their Charter rights to life, liberty and security of the person—and equality—are being violated by the Ontario government's permission for the expansion of these toxic industries.

The fates of two men are still entangled in the FBI’s faulty hair analysis from 20 years ago. Both men were found guilty of multiple murders and now one is on the outside, recently released and waiting for a retrial, while the other, after coming within hours of actual execution, is hoping that long-awaited DNA testing will finally prove his innocence. The uncovering of faulty forensic analysis by the FBI 20 years ago means that two men have a second chance at proving their innocence.

In this program, Hazel Henderson and Wayne Silby, lawyer and founder of the Calvert Group of socially responsible mutual funds discuss where these investing trends Silby pioneered, are heading. They discuss how these trends evolved, as both were colleagues at Calvert from its launch in 1982, when Henderson served on Calvert’s Advisory Council with other experts, helping develop Calvert’s social screens. These screens helped steer portfolios away from companies with poor records on pollution, mistreatment of employees, alcohol, tobacco, weapons makers toward the cleaner, greener ethical portfolios of many hundreds of similar funds today. Both agree that these investment vehicles, whether still called “triple bottom line”, SRI, ESG, ethical, or “green” are now mainstream, with their value-based metrics offered by Morgan Stanley’s MSCI group. These funds are now often re-branded more broadly as “impact investing“ seen as more acceptable, and are now offered by mainstream firms from Blackrock and Goldman Sachs to Bank of America. Other terms include “sustainable,“ all widening the market for these funds. Thus, the issue going forward is to monitor these mainstream funds, their values, mission statements and portfolio choices and performance to avoid “greenwashing."

Crime rates of previous decades continue to have a large impact on how the criminal justice system functions today. Proactive policing strategies such as “drug-free zone” laws and “stop-and frisk” were implemented with the best of intentions, but critics say they are not working, and are in fact causing more hardship – for the community and the state’s taxpayers – filling up prisons and infringing on civil rights. What can be done to repair the public’s trust in the system? Are proactive policing strategies like “stop-and-frisk” working? The System looks at how where you live can determine your fate with the police.

Despite predicions of doom, legalization of cannabis has been a boon to Colorado financially with an expected one billion in sales by 2016 and $40 million in excise taxes to be placed in state coffers. There have been some problems with the roll out of the new law, but issues are being addressed through regulation and new ballot measures.

International law is described as “the general principles of law as recognized by civilized nations.” This program adds much-needed depth to that broad definition through a discussion of state sovereignty, domestic law, and international law; the importance of the UN and international courts and tribunals; the role of organizations such as NATO, the IMF, and the Red Cross; and the future of international law. Access to justice: for four billion out of the just over seven billion people on earth this is too expensive, too complicated, blocked by corruption, or simply not available. Lawyers working for the Dutch government devote themselves to the digital innovation of the legal industry. Surprisingly enough, Kenya is a trendsetter in this respect. Under the inspiring guidance of Supreme Court Judge Willy Mutunga, and with the aid of text messaging, smartphones and Twitter, a countrywide network of apps and legal volunteers is built. Injustice is combatted with cell phones instead of law degrees. Kenya is known as a country where corruption is rife; political violence and tribal warfare are the order of the day. There are simply not enough judges and lawyers to turn the many incidents of injustice and violence into cases. But now they have found a way to relieve some of the pressure of work. Supreme Court Judge Willy Mutunga is keen on innovation. He was at the cradle of a system that allows so-called paralegals to be trained throughout the country. They are not proper lawyers but legal volunteers who can offer first aid in conflicts where justice is trampled underfoot. Village chiefs in remote areas and school heads in the slums can do a basic course in legal aid. There are even prisons where the inmates study diligently, mainly for the benefit of their own case of course! Once they have the correct information, spreading it is easy in Kenya. When it comes to cell phone density, Kenya is among the world’s highest scorers. Many legal issues and questions can be dealt with through Twitter or through systems like M-Haki, the mobile justice network. Practically everyone can afford these communication networks, which is perfect in a country where for most people expensive lawsuits are not an option. These networks facilitate justice for all and allow people to combat injustice with cell phones instead of law degrees. In 1989, five black and Latino teenagers from Harlem were arrested and later convicted of raping a white woman in New York City’s Central Park. They spent between 6 and 13 years in prison before a serial rapist confessed that he alone had committed the crime, leading to their convictions being overturned. Set against a backdrop of a decaying city beset by violence and racial tension, Ken Burns tells the story of that horrific crime, the rush to judgment by the police, a media clamoring for sensational stories and an outraged public, and the five lives upended by this miscarriage of justice

Since 1971, when President Richard Nixon declared a "war on drugs," the U.S. government has spent more than $2.5 trillion to fight drug abuse. Although drug use has declined over the past four decades, more than 20 million Americans still use illegal drugs, and the United States incarcerates more drug offenders—many of them nonviolent—than any other nation. This episode of the Green Interview features lawyer Polly Higgins, who in 2010 proposed to the United Nations that a law of Ecocide to be classed as the 5th Crime Against Peace. She defines ecocide as the “extensive damage, destruction to or loss of ecosystems of a given territory, whether by human agency or by other causes, to such an extent that peaceful enjoyment by the inhabitants of that territory has been severely diminished." The term inhabitants here includes ALL living beings, not just people. Higgins has been a vocal spokesperson on Earth Law for a number of years and is recognised as an expert in her field. She argues that current environmental laws aren’t working because they haven’t been able to protect the environment against severe degradation. She also says the laws that govern corporations put profit first: a company has a legal duty to maximize its profits to its shareholders and that a law of ecocide would supersede this and impose a provision that makes us look to the consequences of the profit-making activity.

This episode of The Green Interview features Roger Cox, a Dutch lawyer and author, who led the Dutch Climate Case, the groundbreaking suit brought against the Netherlands on behalf of the Urgenda Foundation and 900 Dutch Citizens. In 2015, the case concluded with an unprecedented verdict in which the district court in The Hague ordered the Dutch government to reduce its greenhouse gas emissions more dramatically than it had intended, arguing it had a duty of care to its citizens. Cox is also the author of the 2011 book, Revolution Justified: Why Only the Law Can Save Us Now, which calls for judicial intervention to save the planet and humanity from dangerous climate change. “Our best hope of averting dangerous climate change and breaking the status quo in the energy world is the law,” he says.

Yet amidst the brutality of war, instances of sexual awakening among soldiers and officers were occuring. Initially, the Army overlooked it, but as the war advanced, they began to crack down: military tribunals, threats of imprisonment, discharge and public exposure. After the war, officers accused of homosexuality were discharged. Back home in Canada, reputations and careers were ruined. This documentary is an inquiry into what came to be known as Saskatoon's infamous "freezing deaths," and the schism between a fearful, mistrustful Indigenous community and a police force harbouring a harrowing secret. One frigid night in January 2000 Darrell Night, an Indigenous man was dumped by two police officers in -20° C temperatures in a barren field on the city outskirts. He survives the ordeal but is stunned to hear that the frozen body of another Indigenous man was discovered in the same area. Days later, another victim, also Native, is found. When Night comes forward with his story, he sets into motion a chain of events: a major RCMP investigation into several suspicious deaths, the conviction of the two constables who abandoned him and the reopening of an old case, leading to a judicial inquiry.
